Criminal Notice: 5 Pounds of Marijuana

In re: APPROXIMATELY 5 POUNDS OF MARIJUANA; et al. NOTICE OF SEIZURE OF PERSONALROPERTY VALUED AT $25,000.00 OR LESS

TO: ALL PERSONS CLAIMING AN INTEREST IN PROPERTY DESCRIBED BELOW

Pursuant to O.C.G.A. § 16-13-49(n), you are hereby notified that on December 28, 2011, the property described below was seized during Moreland Avenue and Henrcio Road, DeKalb County, Georgia by Detective M.C. Wade of the DeKalb County Police Department:

a. Approximately 5 pounds of marijuana; and

b. Two thousand six hundred eighty three dollars ($2,683.00) in U.S. Currency.

Conduct giving rise to said seizure was as follows:

Said property:

a. was directly or indirectly used or intended for use to facilitate a violation of the Georgia Controlled Substances Act, O.C.G.A. § 16-13-30, more specifically, the possession, distribution, sale, or delivery of marijuana,

b. was found in close proximity to said marijuana; or

c. represents proceeds derived or realized from said violation(s) of the Georgia Controlled Substances Act.

More specifically, on December 28, 2011, while patrolling Moreland Avenue at Henrico Road in unincorporated DeKalb County, Officer T.P. Dunn conducted a traffic stop on a pick-up truck for Speeding (67 m.p.h. in a 45 m.p.h. zone). Upon pulling the vehicle over and making contact with the driver, Mr. Willie Lee Dasher, III, Officer Dunn observed his eyes to be bloodshot red and glassy and his breath reeked of an alcohol odor. Upon further observance, Officer Dunn observed there to be a strong odor of Marijuana emitting from the vehicle. Officer Dunn questioned Dasher about the smell of alcohol on his breath, but he denied being under the influence. Mr. Dasher was asked to step out of the vehicle for further investigation. While standing near the rear of the truck, Officer Dunn observed Dasher remove a firearm from his left pant pocket and place it inside the bed of the truck. Upon retrieving the firearm and running it on GCIC, it was revealed that the firearm was stolen out of Henry County. Mr. Dasher was taken into custody, at which time his person was searched, where an undetermined amount of U.S. Currency was located, divided by rubber bands, in both front pant pockets. Upon searching the vehicle, incident to arrest, the Officer located a 375 ml bottle of Seagram’s 7 Whiskey, which was open, half empty and sitting on the front seat under a folder. Upon searching the bed of the truck, Officer Dunn located a blue water cooler that contained 5 pounds of Marijuana which was stored in gallon size zip lock bags and a glass jar. 

Dasher was arrested and transported to the DeKalb County Jail. The U.S. currency was transported to BB&T Bank where it was counted by an employee and determined to be $2,683.00. The currency was then deposited in an account at the bank.

Dasher was charged with Violation of the Georgia Controlled Substances Act. The marijuana is subject to forfeiture pursuant to O.C.G.A. § 16-13-49(d)(1). The currency is subject to forfeiture pursuant to O.C.G.A. § 16-13-49(d)(2).

Pursuant to O.C.G.A. § 16-13-49(n)(3), any claim to the seized property must be sent within thirty days to the seizing law enforcement agency AND to Deputy Chief Assistant District
