DeKalb County physician indicted for Medicaid fraud

A DeKalb County physician has been indicted on grounds he and his former office manager, fraudulently used Medicaid payments to pay for abortions.

Dr. Tyrone Malloy and CathyAnn Warner were indicted by a DeKalb County grand jury on Dec. 8, on two counts of Medicaid Fraud.

According to a press release from the Georgia Attorney General’s Office, Malloy owns and operates Old National Gynecology, a medical practice located in College Park, which performs abortions.

The indictment alleges that beginning around Dec. 9, 2007 and continuing until about Aug. 9, 2010, both Malloy and Warner “knowingly and willfully” received approximately $131,615 they were not entitled to for billing services associated with performing elective abortions.

Malloy and Warner were also charged in the indictment for billing Georgia Medicaid approximately $255,024 for detailed ultrasounds that were never performed.

The Georgia Medicaid program is funded by the state of Georgia and by the United States Department of Health and Human Services, acting through the Centers for Medicare and Medicaid Services.

Since 1976, a federal law known as the Hyde Amendment has prohibited the use of federal funds to pay for elective abortions and services associated with them. Abortions are only covered by Medicaid in cases where the pregnancy is the result of rape, incest or circumstances where continuing the pregnancy will endanger the life of the mother.

According to the Attorney General’s Office, Medicaid fraud is punishable by one to 10 years in prison and a fine of $10,000. Senior Assistant Attorney General Nancy Allstrom is prosecuting the case on behalf of the state of Georgia.

Malloy could not be reached for comment and the Attorney General’s Office would not comment any further on an ongoing investigation.

Reports state the reason the case is being tried in DeKalb County Court rather than Fulton County Court is the Medicaid payments were allegedly sent to Malloy’s Atlanta Ob-Gyn office located off Rainbow Drive in the Decatur area.

I pray that everything is ok with you Unknown, I have been treated by Dr. Malloy and he is a very good doctor and specialist, I'm sure you are fine I'm pregnant now and am thankful to God to be able to carry a child. Next trust God more than anything else, God has our back even when it seems like there is no light at the end of the tunnel don't look at your current circumstances know what God says about your future. I was actually looking up Dr. Malloy to deliver me child bc he is a good doctor who made some unethical decisions with Medicaid. I sad to read this story.

I was a patient about 2 years ago and I had changed my mind at 25 weeks pregnancy and they convinced me that once I started the process there's no stopping. OMG I'm so scared like I didn't even know all of this about this man, like when I did my research earlier there wasn't anything on him and after I heard my friend couldn't have kids because of an abortion went wrong I got scared and typed his name in OMG! And me being so stupid, I didn't even go to a DR after the abortion like I was suppose 2. Lord have mercy I hope there's nothing wrong with me, but I didn't have money or insurance to pay for a DR to go get my checkup and still don't now. I'm scared out my mine if I find out I can't have any kids or somethings wrong and it's been 2 years. I hated to do this didn't want to in the beginning but at the time I was stupid and already didn't have a place to stay as I was migrating from one house to another and my bf didn't want it or me and couldn't find a job because in my mind I was gone keep it and find a job that's reason 4 the late, but when my job search and interviews were unsuccessful I came to Dr. Malloy clinic called Summit or something but originally Atlanta Surgi Center. I feel so stupid and already sad and depress for even doing it but to think something maybe wrong because I didn't get a follow-up I'm scared. I got all the paper work/documents they gave me I got everything but I don't know if it would help the case or me. I just pray to God nothing is wrong with my body and without $$ I can't go find out if it is. Lord, I'm so scared feels like a nightmare.

Ladies " In pain 24/7,
I urge you to speak to Daniel about his follow up article and please! For God's sake place a complaint in against him at the Georgia Medical Board. All complaints are kept strictly confedential. REPORT WHAT HE DID TO YOU! Don't allow any other women to suffer because of him . And look him up on the Georgia Medical Board site. He killed a young mom who came to him for help. She didn't want to abort her 26 week old baby but the clinic convinced her ( Atlanta Surgi Center NOT LICENSED ) and Dr. Malloy did it, even though she was never a candidate for the surgery due to complications,. Guess what? She died, due to his NEGLIGENCE! I know her mother, she is now raising Ms. Mayo's 3 babies. She did win a judgment against him too BTW for half a million$$$$!
It if has not been more than 3 years you can still contact a lawyer!

I as well WAS a long time patient, I'm sorry to inform you, he is a sorry excuse of a doctor.. This man not only messed me up during a surgery procedure and caused me to loose everything but, there's more. Do your research on him. It's time for him to retire!!! God, is going to see that he pays for alllllll the wrong he has done, especially to me and another woman who can not speak for herself.. Make him pay, punish him to the full extent of the law!!!

@Denise, I personally do NOT feel any pity and or sympathy for that animal.. I also have been a patient of his for years and have had several surgeries had the hands of this quack.. His bedside manners, and his disposition is not at questions, it's his ethics, as well as no respect for life, with the extreme love of money!!!.. I had the up most trust in this animal for him to betray it, mess me up during a surgery procedure, and caused me to loose everything due to his negligence!!! This man, and I'm being nice by calling him this needs to be place on a table and have done to him what he has wrongly done to a lot of women. He needs to be punished to the full extent of the law!!!... Now please publish this in your upcoming article!!..

I might be sitting here with blinders on- but the Dr. Malloy I know wouldn't do this! I have been a patient of Dr. Malloy for over 20 years- Anyone who knows him finds this accusation to be so far fetched. He had an awesome as a caretaker during pregnancy and in the delivery room. Now that he limits himself to his regular patience and research- Insurance fraud just doesn't seem right...I'm appalled to even see this.

One thing I do know, is that the Media latches on to information while it's "hot", accusations may not be true- but its never retracted or apologies given when the information is wrong.

Here's praying this is seriously a mistake

Actually, it's the patients and not the doctor who are defrauding all of us by accepting Medicaid - a program for the greed of those who choose to take from society and not give. Gimmee my benefits !
